In June 2011, longtime DeKalb educators Elaine Gold and Amy Shaye initially first filed suit against the District (and were later joined by Heather Hunter and Roderick Benson as co-plaintiffs). This suit concerned a particular retirement benefit applicable to certain employees of the DeKalb County School District. The suit sought class action status in order to join other similarly-situated DeKalb Schools employees in the suit.
After years-long and extensive litigation and negotiations, the parties achieved a mutually agreeable resolution of the Gold/Shaye case. After notice to class-members informing them of their legal rights and other important information and a formal hearing, the Superior Court of DeKalb County approved the Settlement as “fair, reasonable and adequate to all members of the Settlement Class” in a Final Judgment and Order of Dismissal entered on September 17, 2020.
Thereafter, the Settlement was administered through the payment and distribution to Class members of five separate and annual distributions. The final distribution was processed in December of 2024.
At this time, the administration of Settlement is complete. There are no funds remaining for distribution. The informational website and databases used for settlement administration have been deactivated by the Settlement Administrator.
Accordingly, inquiries regarding class membership status—which was dependent on employment criteria such as job title, classification, dates of service, and satisfaction of vesting requirement(s)—are no longer being accepted.
